SmartMoneyBudget is a software platform only.

3. No Financial Advice

SmartMoneyBudget is not:

• An investment adviser
• A mortgage broker
• A credit adviser
• An accountant
• A tax adviser
• A legal service provider

All information and calculations provided through the platform are for informational and organisational purposes only.

Users should seek professional advice before making financial decisions.

4. User-Controlled Financial Information

Users may choose to manually enter information or upload financial statements to the platform.

Users are solely responsible for:

• Information entered into the platform
• Information uploaded to the platform
• Ensuring information is accurate and current

The accuracy of reports and calculations relies on information supplied by the user.

5. No Direct Bank Connectivity

SmartMoneyBudget currently does not:

• Connect to banks
• Connect to financial institutions
• Stream transactions automatically
• Access user bank accounts
• View online banking credentials

Any budgeting information generated by the platform is based solely on information entered or uploaded by users.

Future bank integration features may be introduced only after appropriate legal, compliance, security, licensing, and regulatory requirements have been met.

6. User Accounts

Users are responsible for:

• Protecting account credentials
• Maintaining account security
• Keeping information accurate

Users remain responsible for all activity occurring under their account.

7. Subscription Fees

Membership is free. No subscription fee is charged.

If a paid subscriber plan is offered later, the price will be shown before anyone is asked to pay.

8. Payments

Payments may be processed through:

• Stripe
• PayPal
• Square

SmartMoneyBudget does not store full payment card information.

9. GST

Where required by Australian law, GST may be applied to subscription fees.

If SmartMoneyBudget is not legally required to charge GST, pricing may be displayed exclusive of GST.

10. Refund Policy

Unless required under Australian Consumer Law, subscription payments are generally non-refundable.

Refund requests may be reviewed on a case-by-case basis.

11. Acceptable Use

Users must not:

• Violate any law
• Attempt unauthorised access
• Circumvent security measures
• Disrupt services
• Upload malicious software
• Use the platform for fraudulent purposes

12. Intellectual Property

All software, branding, logos, content, interfaces, designs, and intellectual property relating to SmartMoneyBudget remain the property of SmartMoneyBudget unless otherwise stated.

13. Limitation of Liability

To the maximum extent permitted by law, SmartMoneyBudget is not responsible for:

• Credit decisions
• Tax outcomes
• Lost profits
• Business losses
• Indirect or consequential losses

Users remain responsible for financial decisions made using information generated by the platform.

14. Service Availability

We do not guarantee uninterrupted operation of the platform.

Services may be updated, modified, suspended, or discontinued from time to time.

15. Account Termination

We reserve the right to suspend or terminate accounts that breach these Terms.

16. Australian Consumer Law

Nothing in these Terms excludes rights that cannot legally be excluded under Australian Consumer Law.

17. Governing Law

These Terms are governed by the laws of Western Australia and Australia.
